Datum — Terms of Service

By creating an account or using the Datum app ("Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Datum lets you scan, identify, organise, and value trading cards in a personal collection. Card identification and valuations are automated estimates based on our catalog and third-party data — see §6.

2. Eligibility & accounts

• You must be at least 17 years old (or have parental consent as required by Indonesian law) and able to form a binding contract.
• You sign in with Google or Apple. Keep your login secure; you are responsible for activity under your account. Provide accurate information.
• One account per person unless we agree otherwise.

3. Your content

• You keep all rights to the card data and photos you add ("Your Content").
• You grant us a limited, non-exclusive licence to host, store, process, and display Your Content solely to operate the Service for you (e.g. show your collection, identify cards). We do not use your photos to train our grading models (see the Privacy Policy).
• You are responsible for Your Content and confirm you have the right to upload it.

4. Acceptable use

Don't: break the law; infringe others' rights; upload malware; scrape, reverse-engineer, overload, or disrupt the Service; resell or misrepresent it; or use it to deceive. We may suspend or remove accounts that do.

5. Cards, grading & marketplace

• Identification is automated and may be wrong; verify before relying on it.
• Grading (e.g. via Kios Kultura) is a separate, optional service with its own terms and pricing; we are not responsible for third-party grading outcomes or timelines. Not active in this version.
• Marketplace / auctions are not part of this version. If launched, separate terms will apply and be presented before you use them.

6. Valuation disclaimer (important)

Estimated values are informational only, derived from third-party market data, may be delayed or inaccurate, and do not account for the specific condition of your card. They are not an appraisal, an offer, or financial/investment advice, and we do not guarantee you can buy or sell at any shown value. Decisions you make are your own.

7. Third-party services

The Service relies on third parties (Google, Apple, card-data and pricing providers, hosting). Their terms and privacy policies apply to your use of their parts; we are not responsible for them.

8. Intellectual property

The Datum app, branding, catalog compilation, and software are owned by us or our licensors and protected by law. These Terms grant you a personal, non-transferable, revocable licence to use the app — nothing more. "Datum", logos, and related marks are our trademarks. Card names/images are the property of their respective rights holders.

9. Availability & changes

We may modify, suspend, or discontinue features at any time. We aim for high availability but the Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by Indonesian law, we are not liable for indirect, incidental, or consequential damages, or for lost profits, data, or the accuracy of valuations/identification. Our total liability for any claim is limited to the total amount you paid us for the Service in the 12 months before the claim (the Service is currently provided free of charge).

11. Indemnity

You agree to indemnify us against claims arising from Your Content or your misuse of the Service or breach of these Terms.

12. Termination

You may stop using the Service and delete your account anytime. We may suspend or terminate access for breach of these Terms or to comply with law. Sections that by nature should survive (e.g. 6, 8, 10, 11, 13) survive termination.

13. Governing law & disputes

These Terms are governed by the laws of the Republic of Indonesia. Disputes will be resolved by the competent courts of the Republic of Indonesia.

14. Changes to these Terms

We may update these Terms; for material changes we notify you in-app or by email before they take effect. Continued use after that means you accept the updated Terms.
